| 摘 要： | 在司法实践中,由于中国法律对侵害婚姻关系造成对第三人的反射性损害未有明确的规定,以致各地法院在审理此类案件时由于认识上的差异而出现不同的判决结果,这对遭受反射性损害的第三人之保护极为不利,建议立法予以完善.

| Abstract: | In actual judicial practice,the reflection nature damage to third people has not had explicit regulations since our country law brings about to encroaching on marriage relation,the judge bears fruit to such an extent as everywhere the court is when bringing this kind law case to trial different because of knowing upper difference.This is extremely harmful for protection of third suffering people of the nature damage reflecting.It is proposed that we should improve our country's legislation. |
