试论建材大幅涨价造成的合同履行障碍

2002年以来，钢材、水泥、沙子等主要建材价格大幅度上涨，使建设工程固定总价合同的履行产生了严重障碍。本文论述了关于固定总价合同，在合同履行期间遇到建材大幅上涨，如严格按照原合同履行会使当事人之间的利益显失公平，应当按照情势变更原则变更合同，调整合同价款以平衡当事人之间的利益。
