Abstract: | The authors provide an overview of the legal elements of the prima facie case of disability discrimination under the Americans with Disabilities Act (ADA) and examine the impact of expert evidence in ADA litigation. The authors then present a model for classifying and understanding admissibility determinations involving scientific knowledge and clinical observations in cases brought under ADA. The model may be used to help analyze admissibility outcomes regarding expert evidence presented in ADA litigation. (PsycINFO Database Record (c) 2010 APA, all rights reserved) |
