论审判独立与对审判权监督之间的统一性

审判独立及对审判权的监督作为司法运行过程中的两种现象，其对立冲突是客观存在的，但这是表层次的，在深层次上，两者之间具有高度的和谐统一关系，具体表现在：人民权利是两者共同的逻辑起点；司法公正是两者共同的价值追求；法治实践是两者统一的现实基础；审判程序是两者和谐结合的共同场域。在司法改革进程中必须充分认识到审判独立与对审判权监督之间的统一性。

On the Coherence between the Trial Independence and the Supervision to Jurisdiction

As two phenomena of the judicatory procedure, the trial independence and the supervision to jurisdiction are necessarily to have conflicts. But on the root, they have great coherence relation. The peoples right is their common logistic origin; the judicial justice is their common worthiness ; the practice of the rule of law is the common realistic foundation; the judicial procedure is their common combining location. We must adequately realize their coherence relation in the course of our judicial reform.
