| 摘 要： | 厘清高校与大学生之间的法律关系,明确高校学生伤害事故中的法律责任,认定事故中的相关责任方,有助于维护高校、学生以及学生家长的合法权益,推动高校学生伤害事故的妥善处置.通过对高校与大学生的3种法律关系的分析,高校学生伤害事故责任性质的判定,明确归责原则的适用,确定事故的法定构成要件,进一步厘清高校学生伤害事故的法律责任.

| Abstract: | It is helpful to vindicate the legal rights of colleges, students as well as students＇ family and promote proper disposal of injury accidents of college students to clarify the legal relationship between colleges and students, make clear the legal liability in injury accidents of college students and determine the related responsible parties in accidents. Through analysis on 3 legal relation- ships between colleges and students, this paper makes clear the application of doctrine of liability fixation, determine legal constitutive requirements in liability property judgment of injury acci- dents of college students to further clarify legal liability in injury accidents of college students. |
