试论地方水资源保护立法中法律责任设定

面对新时期水资源保护的严峻挑战和紧迫需求,各地正在开展水资源保护相关立法工作。为实现地方水资源保护立法目标及规范效用,从法律责任合理设定的视角,分析了国家与地方水资源保护立法中相关水资源保护的法律责任内容。根据《中华人民共和国立法法》《中华人民共和国行政处罚法》等给予地方立法的权限范围,结合贵州省水资源保护立法过程中法律责任的设定思路,提出了地方水资源保护立法中法律责任设定方案,以期为地方水资源保护立法起到指导作用。

Discussion on assignment of legal liability in local water resources protection legislation

To face the challenge and urgent demand of water resource protection in the new era, the local governments in different level are carrying out legislation job for water resources protection. In order to realize the legislative goal and regulation effect of local water resources protection legislation, the article analyzes the legal liability clauses of water conservation legislation in national-level and local government-level from the perspective of reasonable enactment of legal liability. According to the jurisdiction of local legislative authority granted by Legislative law of the People's Republic of China and Law of the People's Republic of China on Administrative Penalties and combining with the designed ideas in the legal liability of water resources protection legislation in Guizhou Province, the design framework of the local water resources protection legislation is put forward so as to play a guiding role for the local water resources protection legislation.
