| 摘 要： | 在维护现土地征用农民土地权益的思考中,改政策性维权为法律维权。建立农地发展权,赋予两种公有土地所有权主体平等的民事地位,赋予两种土地所有权平等的财产权能,也不失为一种途径和方式。为此,区分公益性征地与非公益性征地是前提,完善农民集体所有土地法人是关键。

| Abstract: | Policy rights maintenance should be changed into legal rights maintenance in present land collection reform so as to protect peasants' legal rights for their land.It is a sensible means to establish farm land developing rights and give equal rights to the legal entities in terms of two types of public lands and their legal ownership for the lands.Therefore it is requisite to distinguish land collection for public benefits and land collection for non-public benefits and to clarify the legal entity of peasants' collective lands rights. |
