| 摘 要： | 立功是刑法对有立功表现的犯罪分子从宽处罚的一项刑罚裁量制度，它具有主体特定、时间特定、地位独立、内容法定等特征。构成立功，要求犯罪分子到案后判决生效前实施了法定的五种行为之一并经司法机关查证属实。应制定相关配套措施、修改自首并重大立功的处罚原则及减轻处罚原则，以完善立功制度。

On Meritorious Service |

| Abstract: | Meritorious service is a special discount punishment system given to those criminals who perform meritorious services. It has the characteristics of special corpus, special time, independent position and legal content. To constitute a meritorious service requires the criminal to perform one of the five legal meritorious services which is verified through investigation. To perfect the system, we should draw up some related integrating measures and modify the punishment principle of not only voluntary surrender or major meritorious service and the principle of mitigated punishment. |
