| 摘 要： | 对于违约是否包括精神损害赔偿,学界有不同的观点,通说认为不予赔偿。本文通过分析传统的观点,并进行比较法上的考察,认为在违约责任中可以适用精神损害赔偿。同时就如何建构违约的精神损害赔偿制度提出了建议。

| Abstract: | On the problem of whether the liability for breach of contract contains the compensation for moral damage, the judiciary circle have disputes. Prevalent view shows that mental damage evoked by breach of contract should not be compensated. This article draws a conclusion that liability for breach of contracts can be applied in mental damage by theoretical analysis and observation from comparatives law . At last, the present author gives some suggestions on how to restruct system of compensation of moral damage for breach of contract. |
