| 摘 要： | 水行政执法主体可分为职权性水行政执法主体和受权性水行政执法主体，前者是由国家领导、管理职能决定的，后者是法律授权的。案例一：“兴安县人民政府防汛抗旱指挥部”和案例二：“环江县水电局”都是受权性水行政执法主体。因此，执法主体是合法的，法院判决是错误的。根据现有法律、法规的规定，现广西有３ 种受权性水行政执法主体。

| Abstract: | The water administrative main body of enforcing the law is divided into the functional power and the empowered.The former is determined by state leading and management function .The later is empowered by law.The author analyses two water cases,and thinks that there are three empowered water administrative main bodies of enforcing the law in Guangxi according to laws and codes. |
