船舶融资租赁若干法律问题研究

本文着重研究船舶融资租赁的相关法律问题。先是厘清了船舶融资租赁的概念、法律特征和法律性质，提出了船舶融资租赁属于债权，但与一般的设备融资租赁相比具有更强的物权性这一观点；其次，着眼于我国现阶段融资租赁业仍欠发展的情况，分析了我国船舶融资租赁的环境和现状；最后，就我国船舶融资租赁所面临的种种困境，从法律和金融制度两方面提出了完善建议。

A Study of Legal Issues on Ship Financing Lease

The paper focuses on some relative legal issues in ship financing lease. At first, the concept, the legal character and legal nature of ship financing lease are clarified. Although the ship financing lease is of creditor＇ s rights, compared with the equipment financing lease, it possesses stronger characteristics of property rights. Aiming at the underdevelopment of China＇ s financing lease industry at present, the paper analyzes the environment and status quo of the ship financing lease in China. Perfect suggestions are put forward in terms of law and financial system to tackle the difficuhies China＇s ship financing lease is facing.
