| 摘 要： | 辨析政党关系法治化的内涵是政党政治的基本理论问题和重大实践问题。从软法理论的视角来看,我国学者关于政党关系法治化内涵的观点可分为二种:硬法之治和软法之治。本文从政党关系法治化的目的、手段和表现形式三个方面探讨了我国政党关系法治化的含义,认为政党关系法治化是指以保障人民民主为终极目的,以保障党际民主为直接目的,以对政党权力(主要是执政权)的约束为主要手段,以多种法治形式来规范政党关系的过程。
