| 摘 要： | 我们似乎习惯了通过对权力的监督而实现权力的功能的思维模式 ,然而 ,由于监督制度本身的诸多缺陷 ,它并不是优越于审判权力的精致设计。而且审判权力的诸多缺陷也不是监督所能克服。所以 ,审判功能的实现不能单靠监督 ,其内部制度的构建才具有决定意义

| Abstract: | We seem to be accustomed to the mold of thinking that the function of power can be achieved by the supervision of this power.Yet,because the system of supervision itself has many shortcomings,it is not superior to the power of trial.Furthermore,the shortcoming of the power of trial can not be overcome by the supervision system.In china today, the function of trial can not be realized only through this way,because the internal systematic construction is vital to the supervision. |
