| 摘 要： | 从法理学角度讲，正义是法律制度所要实现的最高目标，也是用来评价和判断法律制度是否具有正当性和合理性的最高价值标准。它是法律制定的立足点，也是法律追求的最高境界。所以，法理学应当把正义作为其永恒的主题，立法上要体现，司法上要保证。

| Abstract: | From the point of view of the science of law and truth,justice is the highest object of the law,and also the best standard of value that evaluates and judges the reasonability and rationality of the law and institution. It is the foothold to draw up the law, and also the highest state that the law seeks. Therefore, the science of law and truth ought to regard the justice as the eternal theme. On one hand, it must embody the spirit of legislation, on the other hand, it must ensure the justice of judiciary. |
