| 摘 要： | 巨额财产来源不明罪的司法实践困境,使得该罪多受学者的质疑,很多学者从罪名、犯罪构成、证明责任、刑罚适用等方面探讨该罪的缺陷与不足.法经济学的研究方法为探讨该罪提供了一个新的视角,通过考察巨额财产来源不明罪的市场供求状况,分析成因,指出只有通过修改条文,实现其刑法效益的最大化,才能从根本上抑制该罪供不应求的市场状况.

| Abstract: | This paper mainly presents an analysis of the market supply, the demand condition and the causes of the crime of holding huge amount of assets from unknown sources. It is pointed out that it is only through revising relevant law articles to maximize the effectiveness of criminal law that the crime in discussion can be adequately prevented and curbed. |
