| 摘 要： | BOT项目的特许权协议是整个项目合同结构中的核心.特许权协议中对于项目权利义务的分配,将影响着后续需签订的合同.特许权期限、项目扩建与改建、项目的移交和不可抗力等问题,尤其需要更多的关注.处理好这些问题,将有助于项目顺利地实施.

| Abstract: | The concession agreement of BOT project is the core of the entire contract structure of the project. Parties' rights and obligations, distributed in the concession agreement,will have an influence on the contracts that will be signed later. We should pay more attention to the terms of concession, the expansion and rebuilding work of the project, the handover of the project and the force majeure ect. If these are well tackled, it will make the project more successfully carried out. |
