摘    要:目前,国家质检总局已经明确要求出口食品生产加工企业应当办理生产许可证。笔者认为上述措施的实施缺乏相应的法律依据,且其付诸实施后,将会引发许多问题。笔者就其可能引发的部分问题做了初步的探讨和分析,籍此希望质检部门能够真正做到“缺位的要到位、越位的要归位、错位的要正位”,确保食品安全法律制度的一致性。

Abstract:AQSIQ clear requires for the first time that the export food production and processing enterprise shall go through the production license. Some researchers believe that the implementation of these measures lack the legal basis. And if implemented, it will cause many problems. Therefore, we do some preliminary discussion and analysis for the part of the problems. At this moment, I hope the quality inspection department can really do that absence should be in place, offside position should be return, false position should turn to the right position. And ensure that the consistency for legal system of food safety.
