三网融合监管措施探析

当前三网融合最大障碍是监管体制,最大难题是法律法规不健全。在调研国外融合网络监管制度、机构和产业监管中的网络中立性等问题的基础上,探索我国三网融合监管对策。建议改革监管体制,建立第三方监管机构,由分业监管逐步过渡到融合监管;建议完善法律法规,对网络中立性、网络知识产权保护、个人信息及隐私保护、公益性电信广电服务立法,为监管提供法律依据;广电尽快完成"政企分离,网台分离"的运营体制改革,培育合格的市场主体;允许电信运营商、广播电视企业与互联网应用提供商合作共建网络基础设施,共同维护网络设施。

Analysis of network monitoring regulatory measures after triple play

In triple play,the biggest obstacle is the convergence of supervisory system,and the biggest problem is the imperfect laws and regulations.Based on the studies of fusion network neutrality of the network supervision system,supervision mechanism and industry in foreign countries,China’s triple play regulatory measures are explored.It is suggested that reform of supervision system is needed to establish the third party supervision mechanism enabling the gradual transition to the integration of regulation supervision.It is suggested that laws and regulations are needed to improve the legislation of network neutrality,network intellectual property protection, personal information and privacy protection, public telecommunications radio and television services,to be able to provide a legal basis for supervision.It is also suggested that operating system reform is needed to separate government functions from enterprise management and to complete network separation as soon as possible so that a qualified market main body can be cultivated.Is is recommended that telecom operators,radio and television business,and Internet video business are allowed to cooperate network infrastructure, and jointly safeguard the network facilities.
