| 摘 要： | 我国《合同法》对表见代理制度的规定过于简略,导致实践中对其认定较为混乱。以其类型和表现形式为研究基础,提出表见代理应当具备主观和客观方面的构成要件以及在认定表见代理时应遵循的原则。
