| 摘 要： | 通过对融资租赁性质的研宛认为,单纯把融资租赁当做是一种民商事活动,抑或仅仅是一种金融业务,都是一种比较偏颇的观点。融资租赁是一种兼有民商事和金融性质的行为,是商业信用和银行信用的复合体。而且,从某种意义上说,恰恰是融资租赁金融性质的特点得以使融资租赁与其它一般的民商事活动区别开来。

| Abstract: | After conducting research on the legal nature of finance leasing,the author of this book points out that it does not show the whole picture to regard finance leasing merely as a simple civil and commercial activity or a mere finance business.Finance leasing is an activity that is of civil,commercial and finance nature,and is a combination of business credit and bank credit.Furthermore,in some sense, the finance nature of the finance leasing is the distinguishing feature that makes it different from other general civil and commercial activities. |
