| 摘 要： | 工程项目风险分担偏好的认知可能具有主体差异性,从而成为未来风险分担潜在争议的根源。为此,对DBB项目实施过程中的主要风险因素的实际分担方案及分担偏好进行数据采集与分析。结果表明:风险实际分担与分担偏好总体上比较一致,但承包商仍然承担了过多的风险;业主与承包商之间的风险分担偏好具有显著性差异的风险因素,通常会导致未来的合同争议。

Empirical Study on Preference and Potential Disputes Recognition of Risk Allocation in Engineering Projects |

| Abstract: | The cognitive differences of different participanton risk allocation preference(RAP)causes the potential disputes of risk allocation. Therefor,the paper collects datum of actual RA program and its RAP among the owners,the contractors and consultants to carry on the statistical analysis. The results show that there are higher level consistency between the actual RA and RAP,but the contractors continue to bear too much risks. For some project risks,the RAP of the owners is different with the contractors’ significantly,which results in the future contract disputes usually. |
