基于农地发展权的土地征收补偿分配探讨

现有土地征收未考虑农地发展权价值,农民利益受损,导致严重的社会矛盾和冲突。建立兼顾国家、集体、个人利益的土地增值收益分配机制对缓解土地征收过程的矛盾和冲突具有重要意义。根据"谁投资谁受益"的原则,以3个利益相关者在农地发展权实现过程中所占投资比例为标准,以农地发展权定价模型为依据,参照生态服务价值理论,以近期城市扩展区域土地征用数据为基础,采用实证分析方法,提出了农地征收增值收益在农民、农村集体和政府之间相对合理的分配比例,以使三者之间利益分配更加均衡。建议国家认可土地发展权,并确定其权属,进一步均衡土地增值收益在国家、集体及个人之间的分配。

Distribution of Agricultural Land Expropriation Compensation on the Basis of Farmland Development Rights

Due to the ignorance of value of farmland development rights in existing agricultural land expropriation,the interests of farmers were hurt and then the serious social contradictions and conflicts occurred. Establishing a land value-added income distribution mechanism which considered national,collective and individual benefits is very significant for alleviating the contradictions and conflicts during the process of land expropriation. According to the principle of "who invests,who benefits",with the standard of investment ratio of three stakeholders in the implementation process of farmland development rights,in terms of land development rights pricing model,with reference to the ecological service value theory,on the basis of the recent urban expansion area land acquisition data and using empirical analysis method,the reasonable and balanced profit distribution proportion of land expropriation value-added income between farmers,rural collective and government was put forward.
