| 摘 要： | 通过比较分析美国和欧盟如何适用反垄断法对专利权滥用行为进行规制,提出判断行使专利权的行为是否属于滥用并需要由反垄断法对此加以规制有两个标准:一是看专利权人的行为是否超出专利法所规定的范围,二是看滥用专利权的行为是否给市场带来过分的竞争限制。

| Abstract: | Firstly this article describes practice about how to apply antimonopoly laws to conducts of abuse of patent rights in America and European Union. Then it expounds that there are two standards to judge if the conducts of a patentee belong to abuse of patent rights. One is whether or not the conducts of a patentee is beyond the range of the patent laws. The other is whether or not the conduct of abuse of patent rights produces excessive restriction to market competition. |
