中欧氢能领域相关法规初步对比

氢能以其高效率的能量转化及零污染排放备受瞩目。但氢能也存在易燃易爆的危险,因此世界各国都对工业产品氢在生产、储运及使用等方面制定了严格的法律法规。通过对比我国和欧盟及德国在氢能领域的基本法律和安全生产与运输的相关法规,发现我国的法规和标准建设并不逊色于欧盟。但在某些方面存在一定差距,例如我国还没有专门针对氢领域从业人员安全保障方面的法规;我国针对氢安全生产的相关法规大都存在于设备、技术检验检测等法规中,没有针对性的法规;以前我国相关的氢能法规都是针对生产及使用规模较小的情况而制定的,随着氢能利用规模逐年加大,需要对现行法规进行修改或制定新法规;我国对法规的监督、管理还很欠缺,需下大力气建设、管理氢能法规。建议成立氢能法律和法规建设的专门机构,由相关学会承担起草提案工作,而政府部门应予以支持。

Comparison between Chinese and European Regulations on Hydrogen Energy Usage

Many countries are putting increased emphasis on hydrogen energy as it is an efficient and carbon-free,environmentally-friendly energy source.However,like petroleum-based fuels and natural gas,hydrogen is flammable and has explosive properties.For this reason,many countries have imposed strict laws and regulations on the production,storage,transportation and utilization of hydrogen.By comparing Chinese regulations on hydrogen production and storage and other relevant basic laws to their counterparts in the European Union,particularly Germany,the article concludes that in general China has not lagged behind in establishing regulations on hydrogen utilization but there are indeed gaps in some areas China needs to close with the European Union.For instance,there are no regulations in place currently in China specifically on the safety of workers dealing with hydrogen;most of regulations on the safety of hydrogen production in China are contained in the regulations on the inspection and testing of equipment and technologies and there is no special law or regulation;existing regulations on hydrogen energy are all for small-scale production and use of hydrogen and as the use of hydrogen energy increases ,China needs to modify existing regulations or to formulate new ones;China＇s supervision and management of hydrogen regulations is currently still inefficient and the government needs to step up the management of these regulations.The author of the article suggests the government establish departments dedicated to managing the development of laws and regulations on the use of hydrogen energy and authorize industry associations to propose and draft such regulations and that the government provide support needed in drafting these regulations.
