在十多年的《公证细则》的执行中,共同遗嘱一直是一个比较有争议的问题。我国现有的相关立法没有明文规定共同遗嘱的效力,共同遗嘱公证存在形式也有很多的争议,这一共同遗嘱的现状,不利于保护当事人的利益,发挥不了共同遗嘱在继承法上的作用。本文针对共同遗嘱公证,如何做好规避执业风险做一粗浅的探讨。

On How to Avoid Practice Risk in Notarization of Joint Wills

Joint wills have been controversial issues in over ten-year carrying out of Wills Notary Rules.The current situation that the validity of the joint wills is not clearly stated in Chinese legislation and the existing forms of notarization are questionable goes against the protection of our parties' interests,and the role of joint will in inherence law can't be played.Therefore,this paper tries to probe into the ways of avoiding practice risk in notarization of joint wills.
