关于控制性详细规划法律地位的思考

通过回顾和总结广州市控制性详细规划实践的经验和教训，从城市规划体系端正对控制性详细规划作用的认识，从城市规划审批主体端正对控制性详细规划法律地位的认识。在此基础上分析城市规划法律化面临的问题以及控制性详细规划法律地位过高的弊端，提出在我国城市高速发展过程中和不成熟的市场经济条件下，控制性详细规划必须留有自由裁量的余地，同时加快政府决策法律化的进程比加快规划法律化的进程更显得重要。

Alternative View on the Leagal Status of Regulatory Detailed Planning

By reviewing the experience and lessons of the practice of regulatory detailed planning in GuangZhou ,and analyzing the system and approval subject of urban planning, academic circles should take a correct recognization to the function and the legal status of regulatory detailed planning. This paper proposes strategies for problem of legal construction, for holding the right of free judgment about regulatory detailed planning. Accordingly ,it proposes to reform it is more important to quick the step of legal construction for government policy-making than to do it for urban planning.
