浅析我国男性性权利刑法保护缺失的原因

性权利作为人身权的重要组成部分，法律应予以平等保护，但我国现行刑法只突出对女性性权利的保护，关于男性尤其成年男性性权利的保护，刑法上几乎是空白。然而世界多数国家及我国港、澳、台地区都已就男性性权利刑法保护进行了全面的立法。在目前男性被性侵案件频发、社会危害日益凸显的背景下，文章认为对人生理的固有认识、男权主义惯性思维、男性被性侵的隐性特征等都是导致我国忽视对男性性权利进行刑法保护的重要原因。随社会的进步，以上因素已经或正在发生变化，现在推动有关男性性权利保护的刑事立法正当其时。

A Brief Analysis on Reasons for Lack of Criminal Law Protection of Male Sexual Rights in Our Country

Sexual rights as an important part of personal rights should be equally protected by law, but the current criminal law of our country only focuses on the protection of the sexual rights of women. The protection of the male sexual rights, especially adult man, is nearly blank on the criminal law. However, most of the countries of the world and China＇s Hong Kong, Macao and Taiwan regions have legislation on criminal law protection of the male sexual rights. In the context of the frequent occurrence of the current male sexual assault cases, and the social harm becoming increasingly prominent, the inherent understanding of human physiology, male chauvinism inertial thinking, the recessive traits of male sexual assault and so on, are carefully analyzed, and these are the important reasons that lead to the neglect of the criminal law protection of male sexual rights in our country. As society progresses, the above factors have been or are being changed, and it is in the right time to promote the relevant criminal legislation of the male sexual rights protection.
