酒后驾车肇事行为的司法认定和立法完善

我国有着悠久的＂酒文化＂,但今天酒后驾驶却对公共交通及社会安全带来极大危害。全国人大常委会在《刑法修正案》（八）中增设了＂危险驾驶＂罪名,以应对全国各地陆续出现的酒后恶性驾驶肇事行为。但是在司法实践中,酒后驾驶肇事行为的司法认定还存在界限不明、难以操作的问题,我国对于酒后驾驶肇事行为的立法也有待进一步完善。

Judicial Cognizance of the Drunk-driving Incidents and Its Perfection in Legislation

There is a long history of ″wine culture″ in China,but now drunk driving causes great damage to public transport and security.In order to overcome the difficulties,dangerous driving crime is added to Amendment（VIII） to the Criminal Law.In practice,it is difficult that the judicial cognizance of the drunk-driving incidents is operated.And its legislation is to be further improved.
