| 摘 要： | 证明标准是民事诉讼证据制度中的一个重要问题,一定的证明标准,对法官认定案件事实具有重要的指导和约束作用.我国学者对证明标准的讨论已有多年,然而一直缺乏一种完全令人信服的观点.文章从纠纷解决的角度,结合民事诉讼的目的、减少不合理地适用证明责任判决等方面,就我国民事诉讼应采用优势证据标准进行了论述.

| Abstract: | The standard of proof in civil litigation is an important question in civil litigation system. A certain standard of proof plays an important role in guiding and restricting the judge. In our country, scholars have been discussing the standard of proof for many years. But there is no entirely compellent viewpoint till now. From the viewpoint of settling entanglements, combining the purpose of civil litigation, and in order to reduce unreasonable judgments according as the burden of proof, this paper discusses the standard of preponderance of the evidence should be adopted. |
