| 摘 要： | 通过分析我国宪政建设的前提假设,指出宪政建设的必要性并非如人们下意识接受的那样确定无疑.通观中国百年宪政史,认为主张宪政建设的目的都在于使国家"富强",这与西方宪政追求限制权力和争取个人自由的价值是不同的.目前中国宪政建设的急需是宪法司法化,认为应该设立独立的宪法法院,作为违宪审查机构.

| Abstract: | The presupposition of Chinese constitutionalism is questioned in this article. Accordingly, a moderately suspect method for constitution research is provided. On the basis of one-century Chinese constitutionalism, the author argues that the objective of constitutionalism in China is to make China "prosperous", which is different from that of western countries in that the objective of western constitutionalism is to pursue limit of power and purse individual freedom. Finally, the author preserves that the present-day constitutionalism in China is in urgent need of constitutional law applied at courts. |
