| 摘 要： | “村法”是民间法的主要表现形式，是研究中国农村的重要切入口。“村法”是指村民集体组织中形成的有关集体和村民活动的规则、习惯的总称，包括正式法和习惯法两方面内容。乡土性与现代性的二元并存是乡政村治下的“村法”最显著的特征，它反映国家法与家族法（宗族法）的相互作用关系，体现国家和村内地方性力量博弈的竞争性均衡。

| Abstract: | The village law is a main form of the civil law. It is the important entry point for the investigation of villages in China. The village law is the general term for the rules and customs observed in the activities of the villagers in their community. The coexistence of villagehood and modernity is the most prominent feature of the village law under township administration, reflecting the interaction between the state law and clan law, and being the embodiment of Nash Equilibrium between the state and local forces. |
