| 摘 要： | 随着工业社会的发展人们对矿产资源的需求性越来越大，而由此显现出来的问题也越来越多。我国现行立法对矿业权制度的构筑，不仅在民法理论上难以达到逻辑自足，而且可操作性差。作者从矿业权的权利性质的界定的角度尝试重新构筑我国的矿业权体系。

| Abstract: | With the development of industrial society, people's demands for the mineral resources are greater and greater. As a result, the problems displayed from this are more and more. The current legislation establishment of mining right in our country, is not only difficult to reach logical self-sustaining on the theory of the civil law, but also difficult to operate. The author of this paper tries to reconstruct the system of mining right of our country from the angle of the definition of the nature of mining right. |
