| 摘 要： | 在各国现行的民事立法中，民法上的人一般指自然人。而我国《民法通则》却把民法上的人表述为“公民”和“公民（自然人）”。通过对民法上的人之历史演进的考察，对自然人与公民概念的比较分析，得出民法上的人之应有内涵，并以此为据，考查我国现行立法之规定，提出改良建议。

| Abstract: | The person in civil law normally indicates natural person in the active legislations of civil law in the countries around the world.While in the General Principles of the Civil Law of the People's Republic of China,person here is represented as "citizen" and "citizen(natural person)".Through analysis of the historical evolution of person in civil law,this paper makes an comparison between the conceptions of citizen and natural person and gets the essence of the person in civil law.On the basis of this and with critical analysis of the active legislation in China,this paper also gives advice to modify it. |
