论我国纺织品外观设计多重法律保护机制的建立

<与贸易有关的知识产权协议>(TRIPS)对纺织品外观设计的保护提出特殊要求,允许各成员国对纺织品外观设计自由选择用版权法或工业品外观设计法保护,对此我国法律却没有相关规定.文章在比较版权保护与工业产权保护二者之优劣的基础上,分析借鉴欧美知识产权相关立法,对在我国建立对纺织品等工业品的外观设计进行工业版权、著作权、专利权多重保护的法律制度提出了建议.

On the Setting-up of the Multiple Legal Protection Mechanism about Appearance Design of Textile in China

TRIPS puts forward a special request about the protection of textile appearance design and allows each member country to freely choose Copyright Law or Industrial Product Appearance Design Law to protect textile appearance design. Our national laws have no correlative provisions yet. On the basis of comparing copyright protection and quality of the industrial property protection and with reference to the relevant legislation of intellectual property right in Europe and America, the suggestion is put forward to set up the legal system of carrying on industrial copyright, copyright, patent right protection of appearance design of such industrial products as the textile, etc. in China.
