中国大学章程的定位分析

给予大学章程一个合理的、明确的定位是制定大学章程的基础。本文从功能、目标及价值三个维度，对大学章程的定位进行分析，认为大学章程应具有维护大学组织理性的功能，表达大学组织“话语”的功能，记载与呈现大学历史的功能；大学章程的目标定位应强调以建立现代大学制度为基本目标，以提高高等学校办学效益为主要目标，以办学自主权的法律化为核心目标；大学章程的价值定位应坚持以人为本，坚持学术自由，坚持大学自治。

The Positioning Analysis of Chinese University Statutes

The foundation of constituting the university statute is to provide it with a legitimate and unambiguous positioning. This paper will analyze the positioning of university statutes from 3 dimensions which are its function localization, goal localization and value localization. It argues that university statutes should have the combined functions of maintaining the university organizational rationale, of delivering the university＇s voice, of recording the history of the university. Secondly, it argues that the basic aim of the university statutes is to establish a modern university system the main objective is to improve the efficiency of universities, and the core objective is to legalize the autonomy of running university. Third, it argues that the value of university statutes should be people-oriented, academic freedom and university autonomy.
