| 摘 要： | 现行法律法规中,关于农村房屋是否可以买卖问题,法律定位模糊,相关的法律法规杂乱无章.实践中,法院审理农村房屋买卖案件的结果不同,使农民不能真正享有物权.通过立法对农村房屋能否买卖以及如何办理买卖手续等问题予以明确,才能从根本上保障农民的合法权益.

| Abstract: | The legal status of rural housing transaction is obscure in the current laws and regulations. The related laws and regulations don＇t make it clear. In practice, the courts adjudge the different outcomes aiming at the cases of rural housing transaction, so peasants can＇t really enjoy property rights. This paper suggests that rural housing transaction and transaction procedures should be defined at legal level. |
