矿产勘查开采监管的理论与实践剖析

矿产勘查开采的监管是矿产资源管理的重要组成部分,党的十八大以来,随着中央持续深入推进简政放权、放管结合、优化服务,政府职能从轻监管重审批逐渐转变为重视事中事后监管。本文从监管的基本概念出发,剖析了矿产勘查开采监管的基本依据、主体、范围、方式及目的,梳理了我国矿产勘查开采监管制度的三个发展阶段及当前制度现状,从理论与实践相结合出发提出完善法律法规,加强顶层制度设计,加强部门联动,推进联合监管执法机制,优化监管手段,提高公众参与监管积极性等完善矿产勘查开采监管的建议。

Theoretical and Practical Analysis of Mineral Exploration and Mining Supervision

The supervision of mineral exploration and mining is an important part of mineral resources management. Since the 18th Central Committee of the Communist Party of China, with the central government has further promoted decentralization, integration, and optimization of services, the functions of government have gradually changed from despising supervision and attaching importance to examination and approval to paying more attention to post-event supervision. Starting from the basic concept of supervision, this paper analyzes the basic basis, subject, scope, mode and purpose of mineral exploration and exploitation supervision, combs the three development stages of China"s mineral exploration and mining supervision system and the current system status. Based on the combination of theory and practice, this paper puts forward some suggestions to improve the supervision of mineral exploration and development, such as perfecting laws and regulations, strengthening the design of top-level system, strengthening the linkage between departments, promoting the joint supervision and law enforcement mechanism, optimizing supervision means, and improving the enthusiasm of public participation in supervision.
