地下水管理立法问题研究

超采地下水带来的严重危害引起了党中央的高度重视和社会的强烈关注。采取包括法律手段在内的综合措施推进地下水超采治理,是贯彻落实中央领导指示精神,缓解地下水超采最有效、有力的措施之一。针对地下水管理立法现状,提出加快制定地下水管理的专门法规,完善规划水资源论证制度和地下水超采区管理制度,建立取水井管理、新增取水区域限批、地下水监测和公众参与等重点管理制度,强化行政责任、法律责任和刑事责任等。

Issues related to legislation for groundwater management

Severe harm caused by groundwater over-exploitation has attracted great attention from leaders of the central government as well as general public. Comprehensive measures, including legal tool, is one of the most effective and powerful approaches for alleviating water shortage and control of groundwater over-exploitation. It is recommended to enact special regulations for groundwater management, complete water resources approval system for making plan and management system in over-exploitation areas, implement control over well for water abstraction and permit for newly-added water withdrawal, monitoring and supervision and public participation. It also needs to reinforce administrative, legal and criminal liabilities.
