移民安置中入股分红模式若干问题的探讨

入股分红模式下,移民让渡项目用地的所有权或者使用权,获得参与项目收益分成的机会和权利。它突破了现有相关法规对土地征收补偿所作出的规定,也符合让农民分享工业化和城市化带来的福利的大方向。但这种模式在入股资源评估的范围与价值评估方法上,还存在进一步完善之处,同时作为一种长期补偿模式,也存在投资决策风险、政策法规风险、经营与管理风险、宏观经济环境风险、项目平衡冲突风险、制度冲突风险。完善入股分红模式,应该从宏观的法规政策和微观操作设计两个层面做进一步探索。

On Several Issues of Getting Dividends by Land Share Resettlement Model

In the resettlement model of getting dividends by land share, the affected persons get the chance to share the benefit of the project through tranfering their land rights.This model breaks the limits of land acquisition compensation of current laws and regulations, and is in line with the delevopment direction of making the affected persons to share the benefits of industrilization and urbanization.However, this resettlement model faces issues need to be cleared, such as the scope and method land evaluation. Also, as a long term resettlement model, it will face some potential risks, such as investment decision-making risk, law and policy changing risk, management risk, microeconomic environment risk, balance between projects risk, contradiction of law and policies risk. To optimize this resettlement models, great efforts should be made to innovate relevant laws and policies and design practical resettlement model based on soecific conditions.
