土地有偿使用制度新思路——“五年租制”

1988年土地有偿使用制度的建立对于我国土地市场和经济发展具有重要意义,但也出现了各种各样的问题,耕地流失等问题日益凸显,在这种背景下本文提出了建立在物权基础上的土地使用长约租赁制——"五年租制",是通过各城市组建国有土地租赁公司,由其代替政府向国有土地使用者每五年收取一次租金,其对象为国有土地使用权期满需要续期或新开发的适于出让用于经营用途的国有土地(不包括商品住宅用地)。本文从4个方面论证实行"土地使用权长约租赁制"的必要性,提出了"五年租制"的内涵、实行的框架及租金征收标准,并提出其实施的保障措施和建议,对进一步完善土地使用有偿制度及发展我国土地市场具有实践指导意义。

New Idea for System of Compensated Use of Land: Five-year Rent System

In 1988 the establishment of system of compensated use of land is important for development in China. However, there have been various problems, such as loss of arable land. In this context, the author creatively proposed "five years lease system", which is a new system . State-owned land rental companies, instead of the government, charge the state-owned land users the rent every five years. It optimizes the system of compensated use of land and has practical significance to the development of the land market.
