试论我国业主委员会的主体资格

为了研究我国业主委员会的法律地位，对目前国内法律规定进行了分析，结合相关域外立法，从业主委员会是否具备民事主体资格和诉讼主体资格两个方面进行论述，解决了业主委员会法律地位应当如何设置的问题，得出我国明确业主委员会法律地位具有重要实际意义的结论。

Discussion on the subject qualifications of domestic proprietor committee

This paper analyzes current domestic laws in order to study the legal position of proprietor committee,discusses whether proprietor committee possesses civil subject qualification and lawsuit qualification by combining with foreign legislation,puts forwards solutions to solve legal position of proprietor committee,and finally concludes that identifying legal position of domestic proprietor committee has significant practical meaning.
