| 摘 要： | 法律关系是法学的基本范畴。但长期以来,我国法学界对作为分析工具的法律关系疏于研究,法律关系的方法论功能在理论上没有得到充分的展示。要进一步提升法律关系的方法论功能、完善法律关系理论模型,需要理论法学界与法律逻辑学界的共同努力。一个成熟的对法律人有影响力的法律关系模型对法治建设有积极的意义。

| Abstract: | legal relation is a basic conception in law.However,as an analysis tool,it has been rarely stud- ied in China's legal circle and its methodological functions are not sufficiently used at theoretical level.In order to improve the methodology function of legal relation and perfect the theoretical model of legal relation, it is necessary for both theoretical law scholars and legal logic scholars make great efforts together.A mature model of legal relation,which carries weight on law people,has active significance to the construction of rule by law. |
