基于核心法律文本的粤港澳规划法规体系研究

粤港澳地区是我国独特的"一国两制三法系"的区域,并由此形成了各具特色的规划法规体系。为进一步探索粤港澳地区未来如何开展规划法规制度上的矛盾协调、借鉴交流与创新,通过充分搜集广东、香港、澳门的规划核心法律文本,在系统完整的梳理三地现行规划法规的立法背景、规划法规的内容安排与运行特征后,发现三地规划法规体系均呈现出与本土制度环境相匹配的渐进式变迁过程。当前国家治理体系现代化的改革语境中,三地规划法规制度协调和融合所创造的良好法治环境将有利于促进粤港澳大湾区合作发展,三地应立足各自制度环境,渐进式地形成既适应本土情况又符合国际惯例的规划法规制度。

Research on Guangdong-Hong Kong-Macao Planning Regulation System Based on Core Legal Texts

The Guangdong-Hong Kong-Macao region is unique in our country for its "one country, two systems," forming its own particular planning laws and regulations. This study intends to explore how Guangdong, Hong Kong, and Macau manage contradictory coordination, exchanges, and innovations in planning laws and regulations in the future. After collecting the core planning laws of Guangdong, Hong Kong, and Macau, and systematically combing the legislative background of the current planning regulations as well as the contents and operational characteristics of the planning regulations of the three places, it is found that the planning and regulation systems of the three places have shown a gradual process of change that matches the local institutional environment. At present, in the context of the modernization of the national governance system, the positive legal environment created by the coordination and integration of the planning regulations and systems of the three places will be conducive to promoting the cooperation and development of the Guangdong-Hong Kong-Macao Greater Bay Area. their respective institutional environments, and gradually form planning laws and regulations that adapt to local conditions and conform to international practices of the three places must be taken into account.
