水资源保护责任研究

从水权 ,水权公有制的垄断性、外部性、市场失效性的特点及水环境权入手 ,根据水资源保护的内涵以及责任与水资源所有权一致的原则 ,谁利用谁补偿、谁开发谁保护、谁污染谁负担的原则 ,尝试性地界定了水资源保护中政府和市场主体的责任 ,探讨了在社会主义市场经济体制下 ,我国政府在水资源保护工作中的主要职责为制定政策、立法、监督管理、水体的综合整治等基础性工作 ,指出水资源保护是主要由政府完成的公共事务 ,政府应采取多种措施筹集资金 ,并安排足额资金 ,以充分履行政府职能。

Study on responsibility for water resources protection

Based on the principle of consistency between the connotation of and responsibility for water resources protection and the ownership of water resources, from the aspects of water right, the characteristics of water right, such as the monopolization, externality, and invalidity of the market, and water environment right, the responsibilities of the government and market were identified for water resources protection. The main responsibilities of the central government for water resources protection under the socialist market economic system were discussed, including the policy formulation, legislation, supervision, management, and comprehensive regulation of water bodies. It is pointed out that water resources protection is a public affair to be undertaken by the government, and that the government should raise adequate funds and invest in water resources protection and fulfill the government's functions.
