法律层面上流失的传统道德

传统道德随着制度、观念和时间的磨砺,其中有些与现代制度、观念等相抵的部分不可避免地遭遇流失。本文仅从法律层面探寻现代政治制度、观念更新及法律体系等诸方面造成传统道德的自然流失、人为流失及客观流失,借此窥视流失中的传统道德在现代法律中应然或必然的处境。

On the Decline of Traditional Morality in the Legal Perspective

With the advance of social system, values and time, some parts of traditional morality which contradict with modern system and values inevitably tend to decline. This paper intends to investigate into the natural, man - made, and objective decline of traditional morality resulted from modern political system, value evolvement and legal system from the legal angle, aiming to catch a glimpse of the position that the declining traditional morality occupies in the modern world of law.
