我国标准专有出版权制度探析

标准专有出版权通常被视为一种知识产权，但在我国，标准专有出版权产生于法律的规定或行政机关的指定，是一种行政特许权，并非知识产权。本文通过比较我国标准专有出版权与普通作品专有出版权的区别，分析标准专有出版权制度存在的问题，建议代之以标准出版市场准入制度，强化标准出版管理，以此来保证标准出版物的质量。

Discussion and Analysis of Exclusive Publishing Right of Standards in China

Exclusive publishing right of standards is normally classified into one kind of intellectual property. The publishing right of standards in China, however, is mainly approved by law regulations or administrative authority which is regarded as the exclusive administratively authorized right rather than intellectual property. Through comparing the differences between exclusive publishing rights of standards and ordinary works, this paper analyses the problem in the system of exclusive publishing right of standards, and suggests that market-access system of standards publication can be adopted as a substitution to improve the management of standards publishing and ensure the quality of standards publications.
