| 摘 要： | 本文分析了我国现行高校处分权性质不明，学生权利救济途径不畅的主要原因是相关法律缺乏、立法严重滞后。为此笔者主张高校处分权应由高校行政处罚权取而代之，建立学生权利救济的申诉制度和行政诉讼制度，以此重构我国高校处分权与学生权利救济制度，并对其进行了论述和探讨。

| Abstract: | This essay argues that the main reason for the uncertainty of the disposing right of academies and the limitation of student's relief right is the absence of related law. So, the writer claims that the disposing right of academies should be replaced by administrative punishment of academies so as to reconstruct the disposing right of academies and student's relief right.Other related issues are also discussed in the paper. |
