| 摘 要： | 精神损害赔偿是人格权法律保护的重要制度。世界上许多国家都在国家赔偿制度中确立了行政精神损害赔偿，而我国的《国家赔偿法》却未明确予以规定。本从行政侵权行为入手，分析了行政侵权造成的精神损害、行政精神损害赔偿责任及我国当前的行政精神损害赔偿的立法不足，并进一步论述了构建我国行政精神损害赔偿立法中应注意的几个问题。

| Abstract: | Compensation for mental damages is one of the important systems of legal protection for rights of personality. Administrative compensation for mental damages is established in state indemnity systems by many countries while there is no explicit definition in the State Compensation Law in China. Beginning with administrative tort, this article analyzes the mental damages caused by administrative tort and responsibility of compensation for administrative mental damages and legislation defect of compensation for administrative mental damages in our country presently. Furthermore, this article discusses a few important problems which should be taken seriously in building legislation of compensation for administrative mental damages. |
