论行政主体的理论基础

行政主体是行政法学理论研究中的一个重要概念,近年来我国学者对之作了许多探讨,但见解不一.实际上,行政主体作为一个理论概念,必然有其产生与存在的理论基础.只有深入地对该理论基础进行分析研究,才能科学地揭示其内涵,准确地界定其范围,并进而明确其权责关系,构建系统的行政主体理论体系.行政主体概念产生与存在的理论基础,包括行为学基础,即现代行政观念;法哲学基础,即人的主体性彰显;以及法技术基础,即法人制度.

On Theoretical Basis of Administrative Subject

Administrative being, a very important concept of administration law, is nowadays being dissussed by many scholars in China, but without unanimous views. It is shown that since it is a theoretical concept, administrative Subject cannot be built without relevant theoretical basis. So there is nothing to do but study the basis seriously to disclose its connotation scientifically, specify its extension, classify the relation between its power and obligation, establish the system of the administrative Subject. Furthermore, it shows in the context that the theoretical basis on which the concept of the administrative Subject bases is made up of behavior science, ie,modern administrative thought, legal philosophy basis, ie the relevation of human; and legislative technology basis, ie, the system of legal person.
