| 摘 要： | "分割合同"是指在同一份施工合同中,针对不同工程部位约定不同工程款支付方式的合同形式。分割合同可以更加合理地分配项目参与人的工程项目风险,具有积极的理论与实践意义,但在应用过程中应注意与我国工程法律环境相协调,处理好项目招标与合同签订阶段的法律风险。
